These Terms & Conditions (“Terms”) govern your access to and use of the website SuperApps by Rainwater Labs, the SuperApps mobile applications, and all related tools, features, software, and services (collectively, the “Services”).

The Services are owned and operated by Rainwater Labs Private Limited (“Company”, “we”, “our”, “us”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services immediately.

1. Definitions

  • “User”, “You”, “Your”: Any individual or business accessing or using the Services.
  • “Platform”: SuperApps by Rainwater Labs (web + mobile apps).
  • “Business Listing”: Any information, images, creatives, or content uploaded by users.
  • “AI Tools”: AI-based generation, automation, recommendations, insights.
  • “Campaign Tools”: Marketing campaign setup, automation across third-party platforms.
  • “Content”: Any data, images, text, logos, materials uploaded or generated.

2. Eligibility

  • You must be at least 18 years old to use the Services.
  • You must have authority to represent the registered business.
  • You confirm all provided information is accurate and lawful.

3. Account Registration

  • Browsing may be permitted without registration.
  • Functional features require account creation.
  • You are responsible for maintaining account confidentiality.
  • You are responsible for activities under your account.
  • We may disable accounts violating laws or Terms.

4. Business Listings & User-Generated Content

By uploading content, you agree that:

  • You own or have rights to the content.
  • You grant Rainwater Labs a license to use the content for operating the Services.
  • You will not upload unlawful or harmful materials.
  • The Platform may edit or remove content for compliance.

5. AI Tools and Automated Features

  • AI outputs may contain inaccuracies.
  • You must validate AI-generated content before use.
  • No guarantee of performance or commercial results.
  • Your data is not used to train models.
  • You must not use AI outputs unlawfully.

6. Campaign Tools & Integrations

  • Performance depends on third-party algorithms.
  • You authorize programmatic campaign creation.
  • Your ads must comply with platform policies.
  • We are not responsible for rejection by third-party platforms.
  • You must provide accurate budget and creative data.

7. Payments, Billing & Refunds

  • Payments processed via Razorpay.
  • We do not store card numbers.
  • Recurring debits require your authorization.
  • Payments are non-refundable unless required by law.
  • Billing disputes must be reported within 7 days.

8. Prohibited Activities

  • Uploading harmful or unlawful content
  • Impersonation
  • Unauthorized access attempts
  • Fraudulent campaigns
  • Scraping or harvesting data
  • Reverse engineering

9. Intellectual Property Rights

  • Platform IP belongs to Rainwater Labs.
  • Users retain ownership of uploaded content.
  • No rights are transferred except as stated.
  • Copying or exploiting Services requires permission.

10. Data Protection & Privacy

Your use is governed by our Privacy Policy, covering:

  • GDPR, DPDP, CCPA compliance
  • Cookie usage
  • AI data handling
  • Automated decisions
  • Account deletion
  • International transfers via AWS

11. Account Deletion

  • Users may delete accounts anytime.
  • Personal data is removed; some listings may remain public.
  • Legal data may be kept for up to 24 months.

12. Service Availability & Changes

  • We may modify or discontinue Services anytime.
  • No guarantee of uninterrupted availability.
  • New features or limits may be introduced.

13. Disclaimers

  • Services provided “as is”.
  • No guarantee of marketing results.
  • Not responsible for AI errors.
  • No liability for unauthorized access caused by user negligence.

14. Limitation of Liability

  • No liability for indirect or consequential damages.
  • Maximum liability limited to fees paid in last 12 months.
  • No responsibility for third-party failures.

15. Indemnification

You agree to indemnify Rainwater Labs against losses arising from:

  • Misuse of Services
  • Violation of Terms
  • Infringement of third-party rights
  • Uploaded content or campaigns

16. Third-Party Services

Integrated platforms (Google, Meta, LinkedIn, etc.) have their own terms. We are not responsible for their actions.

17. Governing Law & Dispute Resolution

  • Governed by laws of India.
  • Disputes resolved through good-faith negotiation.
  • Unresolved disputes go to arbitration (Gurugram, Haryana).
  • Language: English.

18. Termination

  • We may suspend accounts for violations.
  • Users may stop using Services anytime.

19. Changes to These Terms

We may update Terms periodically. Continued use means acceptance of updated Terms.
